The climate, weather, and hazard data presented on this platform is sourced from third-party APIs and scientific databases. While we strive to present accurate and timely information, ClimateSmartWeather makes no warranties or representations regarding the accuracy, completeness, timeliness, or reliability of any data displayed. Weather and natural hazard data is inherently uncertain and subject to rapid change. You should not rely solely on this platform for emergency preparedness, evacuation decisions, or safety-critical activities. Always consult official government emergency management agencies and local authorities for life-safety decisions.

You may use the Service for lawful, personal, and non-commercial purposes. The Service and its original content (excluding data sourced from third-party APIs), features, and functionality are and will remain the exclusive property of ClimateSmartWeather and its licensors. The ClimateSmartWeather name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ClimateSmartWeather. You must not use such marks without the prior written permission of ClimateSmartWeather. Third-party data remains the property of the respective data providers and is subject to their own terms and licenses.

The Service integrates data from the following third-party sources: USGS Earthquake Hazards Program, NASA Earth Observatory and EONET, NOAA National Centers for Environmental Information, National Weather Service, European Space Agency, OpenWeatherMap, RainViewer, and GNews. Each of these data providers maintains their own terms of service and data use policies. ClimateSmartWeather is not responsible for the content, accuracy, or availability of third-party data sources.

To the maximum extent permitted by applicable law, ClimateSmartWeather shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of (or inability to access or use) the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content. In no event shall ClimateSmartWeather's aggregate liability exceed one hundred US dollars ($100.00).

You agree to defend, indemnify, and hold harmless ClimateSmartWeather and its licensors, service providers, employees, agents, officers, and directors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which ClimateSmartWeather operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
